Fun and Sun Rentals LLC Rental and Liability Agreement
In connection with his/her rental of bicycle (s), kayak (s), paddle board(s), beach, backyard, indoor or any other furniture or equipment (referred to herein as the Rental Equipment) from FUN AND SUN RENTALS LLC of Scarborough, ME, Renter understands, acknowledges and agrees for him/herself and for users of the Rental Equipment authorized by Renter that
1. There is risk of accident and/or injury, including death, in the operation/use of the Rental Equipment.
2. The Rental Equipment will be inspected before use by Renter or Renter’s representative. If any Rental Equipment is deemed unsatisfactory, Renter will advise FUN AND SUN RENTALS LLC immediately and Renter will not use the unsatisfactory Rental Equipment or permit it to be used.
3. The Rental Equipment will be used in accordance with all applicable laws and regulations.
4. The Rental Equipment will be returned in the same condition as received, normal wear and tear excepted. Renter assumes all responsibility for misplaced, incomplete, lost and/or stolen equipment.
5. Renter hereby releases, waives, discharges, and holds harmless FUN AND SUN RENTALS LLC and/or its owners, employees, contractors and agents from any and all liability for any damages and/or injuries sustained in connection with the operation, use, or misuse of Rental Equipment. Renter assumes all liability for injuries as a result of use, misuse or lack of proper supervision. SUN AND FUN RENTALS LLC does not warrant or guarantee the fitness of the equipment for intended use.
6. All disputes resulting from this rental will be resolved according to the laws of the State of Maine and any and all legal actions will be brought in and take place in York or Cumberland County, Maine.
